Apparently they were “too drunk” to give consent to take a breathalyzer. The news comes from WSBTV in Georgia, which states two men have battled (and won) their case all the way to the Georgia supreme court. The ruling was made when it was ruled that a blood test was taken of an accused man without him knowing and presented as evidence to his DUI.
